Definition of Acceptance
Section 2(b) Contracts Act 1950:
“When the person to whom the proposal is made signifies his assent thereto, the proposal is said to be accepted.
When communication of acceptance is deemed to be made?
Auth: Sec. 3 (same w/ offer)
“The communication of …the acceptance of proposals,…are deemed
to be made by any act or omission of the party…accepting,…by which he
intends to communicate the…acceptance,…or which has the effect of
communicating it.”
When a communication of an acceptance is said to be completed?
Auth: Sec. 4(2)(b)
(b)…as against the acceptor, when it comes to
the knowledge of the proposer.”
Revocation of Acceptance – When?
Auth: Sec. 5(2)
“An acceptance may be revoked
at any time BEFORE the communication of the
acceptance is complete as against the acceptor,
but not afterwards.”
When Revocation of acceptance is said to be communicated?
-Auth: Sec. 4(3)(b) “as against the person to whom it is made, when it
comes to his knowledge.”
Rule of Acceptance
- Acceptance must be absolute &
unqualified - Acceptance must be expressed in
some usual & reasonable manner
