What are the 2 models of criminal justice?
Due Process
Crime Control
What is Due Process?
The presumption of Innocence.
Protects the rights of suspects and defendants.
Obstacle Course- prosecutors overcome to secure a conviction.
Lesser evil than convicting innocent.
Protect the accused from oppression by the state and its agents.
What is Crime Control?
Aims to suppress crimes- it’s a threat to people’s freedom.
Presumption of guilt- trust police
Police should investigate without legal hinderance.
Conveyer Belt System - speeds up process.
Rights of society and victims.
Few innocent people are occasionally convicted by mistake.
Theories that link to Due Process?
Left Realism- society is to blame for crime, e.g. poverty, unequal structure, relative deprivation.
Labelling Theory- self-fulfilling prophecy, 2nd Chance, allowing change and acknowledging a reason.
Theories that link to Crime Control?
Right Realism- Individual is blamed, biological differences, rational choice theory.
Functionalism- crimes needed for society to progress, boundary maintenance and social change
