What do the police do?

A

enforce the criminal law, they investigate crimes, collect evidence, arrest detain and question suspects and then send files to the CPS who decide whether to prosecute.

A

Giving evidence as prosecution witnesses, provides protection for vulnerable witnesses, holding defendants in police cells and transporting them to and from court. Seek search and arrest warrants.

A

Independent prosecution service in the UK, deal with 500,000 cases a year. It uses the Full code test to decide whether to put a case forward (evidential test and public interest test)

What is the CPS relationship with the police?

A

Advising on possible lines of enquiry and evidence collection to build a case, advises them on charging a suspect. It also ensure there is a realistic prospect of conviction(evidential test) and that is is in the publics interest to prosecute(public interest test)

A

Preparing and presenting the prosecution case against the offenders, preparing appeals against unduly lenient sentences.

What does the HM prison services do?

A

Keeps offenders in custody and helps them to lead law abiding and useful life’s in prison and upon release. Supervises public prisoners in England and Wales. More crime is often committed in prisons and so offenders sentences may be extended.

What does the national probation service do?

A

Supervising offenders who are not serving a custodial sentence, serving community orders, DT orders, supervision orders etc. They supervise the management and punishment and try to rehabilitate offenders so they are able to function in society.

What is the Magistrates court?

A

deals with summary offences and triable either way offences. Cases are heard by 3 lay magistrates, can give up to 12 months in prison and a fine of any amount.

What is the Crown court?

A

deals with indictable and triable either way offences. Cases are heard by a judge and a jury of 12 lay people. Judges help make decisions and explain things to the jury. Jury give their verdict after hearing all evidence.

A

supervising the efficient running of the courts system, funding the individual courts.

A

hold prisoners attending court pending their transfer. Arrange recording and live links for prisoners given evidence from prison.

What is the Ministry of Justice?

A

created in 2007, it is a government departments and the minister of justice is a member of the cabinet. It is responsible for the court system, legal aid, the legal profession, judges, prisons, penal policing, probation and offender management.

Who does the MOJ work with?

A

Works with a number of government agencies such as the HM courts and Tribunal service, HM prison service, legal aid agency, family court and advisory service and the parole board.
