What type of offence is ABH and what is the maximum prison sentence?
It is a triable-either-way offence the maximum prison sentence is 5 years
What is the definition of ABH?
A common assault (assault or battery) which occasions actual bodily harm
What is Stage 1 of ABH?
D must commit a ‘common assault’ - either an assault or battery
What is Stage 2 of ABH?
Occasion - meaning causation
What is Stage 3 of ABH?
There must be an ABH injury
What is the definition of ABH under Miller?
Any hurt or injury calculated to interfere with the health or comfort of the victim
