CONFIDENTIALITY
2.1
DISCLOSING LIMITS OF CONFIDENTIALITY
Therapists disclose at the outset their right to confidentiality, including at what point confidentiality is legally overridden

WRITTEN AUTHORIZATION TO RELEASE CLIENT INFO
Therapists don’t disclose info without written waiver fo confidentiality, or when permitted by law. Verbal authorization NOT GOOD ENOUGH. Even in family therapy, therapist does not disclose an individual’s info to another individual in that client unit

CLIENT ACCESS TO RECORDS
The records are the clients. they have reasonable rights to see them. But for client units, all have to sign a waiver before an individual from that unit sees the records including information about the others. Only conceal records from client when it could hurt the client.

If therapist wants to use client materials in teaching, consulting, research, or public presentations, they must have written consent from the client

b) convicted of misdemeanor related to practice

d) expelled from professional organizations
e) have license/certification revoked
f) cont to practice after no longer competent due to impairment
g) fail to cooperate with the association at any point from inception of ethical complaint

RESPONSIBILITY TO STUDENTS AND SUPERVISEES
Basically, no sex, no exploitation, no therapy for students, be professional… supervisors have to make sure student is competent for what they’re doing…. avoid multiple relatinships betwen supervisor/supervisee… don;t disclose confidences without written consent… no financial arrangements

RESEARCH PUBLICATION
Basically, get research approved, protect participants, informed consent of participants, participants cant withdraw or decline at any point, researchd ata is confidential, don’t fabricate results, make sure authorship is done correctly, don’t plagiarize, publish accurate info

TECHNOLOGY-ASSISTED PROFESSIONAL SERVICES
Basically, make sure you follow laws for all states before doing therapy, make sure its right for the client, inform clients of risks, make sure it’s secure, MUST HAVE TRAINING, need consent to treat, find tech that maintains confidentiality, document confidentially, don’t use tech outside allowed jurisdiction, use up to date tech

PROFESSIONAL EVALUATIONS
Basically, you can perform forensic services in keeping with applicable laws and competencies… be accurate and fair in testimony, not misleading… be competent if you are going to testify… get informed consent to evaluate… avoid conflicts between therapy and evaluations… avoid dual roles of therapist/evaluator… avoid conlficts of interest by evaluating therapy clients for custody etc… don’t give profesional opinions about peolpe you haven’t evaluated… clients must be informed if role provision of services in MFT change mandated by law… be familiar with judicial law/rules when evaluating

FINANCIAL ARRANGEMENTS
Basically, don’t accept kickbacks, rebates, bonuses or other renumeration for referrals… disclose financial policies BEFORE therapy starts… give unpaid clients reasonable notice before payment recovery… be honest with clients about services… don’t barter unless the client requests it, its not exploitative, relationship is not distorded and a clear contract is written… you don’t get to withhold records jsut because they do’nt pay

ADVERTISING
When advertising, basically… represent services accurately, advertisements should be true, don’t call yourself part of an association if you’re not… don’t identify yourself with any place through any means if you’re not actually a part of them (aka don’t use their letterhead or business card etc)… only use credentials that apply… be honest about qualifications… only say you specialize in something after TRAINING in that specialization… correct misinformation ASAP
