What is succession?

A

Succession is a mode of acquisition by virtue of
which the property, rights and obligations to the
extent of the value of the inheritance of a person, are
transmitted through his death to another or others
either by his will or by operation of law. (Art. 774,
NCC; Heirs of Ciriaco Bayog-Ang v. Quinones, G.R. No.
205680, 21 Nov. 2018)

Rule on Future Inheritance?

A

GR: No contract may be entered into upon future
inheritance. (Art. 1347(2), NCC)
XPNs:

  1. Partition inter vivos (Art. 1080, NCC)
  2. Donations propter nuptias by future spouses to
    each other of future property
