- To a marked Degree:
o this limiting condition comprises 2 separate components, both must be present for the condition to be met: Pervasiveness and Intensity.
♣ Pervasiveness: children demonstrate the characteristics of their disturbance across almost all domains (school, home, community) and with almost all individuals.
♣ Intensity: demonstration of negative behaviors in an overt, acute and observable manner. The behavior must produce significant distress either to the individual or to others in his environment and must be primarily related to the SED condition.

- Adversely Affects Educational Performance:
o the negative behaviors of the child must occur in school setting and result in impairment of the child’s ability to benefit from that setting.
o if the child is able to demonstrate progress in the regular educational program or in a “less restrictive” special educational setting, then classification of that child as SED is neither necessary nor appropriate.
o there are a number of ways in which adverse effect upon educational performance can be determined: through consideration of the child’s academic achievement, documented teacher observations, work samples of the child, and criterion-referenced assessment and grade reports.
