Habit (Evidence Law)
A
Habit is a regular response to a repeated situation (e.g., always fastening your seatbelt or always picking the same lottery numbers). Habit evidence is admissible to show conduct in conformity with the habit on a particular occasion (e.g., to establish that an individual buckled her seatbelt or picked certain lottery numbers on a particular occasion). The more automatic the behavior, the more likely it is to be admitted as habit evidence.
