what do the ECtHR do?

- The accused should not be compelled to answer based on punishment, the answers are used to convict
- The court cannot draw adverse inferences from lack of answers
- not an absolute right (Murray v UK)

The right to have no adverse inferences drawn byb no answers is not absolute.

4 rights of the defence
A(6)(3)(a):
- right to be informed of accusation in language they understand
A(6)(3)(b)
- given adequate time and facilities to prepare defence
A(6)(3)(c)
- right to defend oneself in person with given access to legal services if needed.
