By an INDEPENDENT AND IMPARTIAL TRIBUNAL in the DETERMINATION OF HIS RIGHTS and of any criminal charge.

RIGHT TO BE PRESUMED INNOCENT TILL PROVEN GUILTY.
AND… no penal offense at the time? Not guilty then.
Nor shall a heavier penalty be imposed than the one applicable at the time it was committed.
