When do police get involved in serving protection orders?
- respondent holds a firearms licence
- respondent believed to be in possession of/have access to firearm
- service is deemed as being a significant risk to the server
- PO is granted without notice
When is a YP deemed to be protected by a PO?
- until they leave home
- when the order is discharged
What is the minimum age and requirements for a PO to be taken against someone?
child aged 16 or over and the order is justified by special circumstances
What are standard conditions of a PO?
- non-violence conditions
- non-contact conditions
- consent to contact
- stopping contact
What are exceptions to the non-contact conditions?
- reasonably necessary in emergency
- permitted under any order or written agreement regarding contact, care or custody of CYP
- permitted under special condition of the PO
- for attending a FGC
- to attend proceeding at court
What are the conditions relating to weapons?
respondent must not possess or have any weapon under their control, or hold a firearms licence.
Must surrender as soon as practicable and within 24hrs and on demand made, at any time, by a constable.
What occurs to a firearms licence on the making of a PO?
firearms licence deemed to be suspended. Deemed to be revoked when the order becomes final.
Who can make an application for a child?
- by a representative
- if aged 16 or over can do without representative
- if authorised under rules of court to do so without a representative
