accounting is only an issue if
multiple beneficiaries
accounting: general rule
trustee must treat all beneficiaries fairly (even if eg take at dif times, or income beneficiaries vs remaindermen)
dividends: how divided
depends on if cash or stock
cash dividends: how divided
treated as income, go to income beneficiary
stock dividends: how divided
treated as principal, go to the remaindermen
problematic kinds of assets
1) nonproductive
2) wasting
nonproductive asset: def
benefits only remaindermen, not the income beneficiary
wasting asset: def
benefits only income beneficiary, not remaindermen, bc slowly depleted over time
trustee’s duty for both problematic assets
sell the property and invest in an income producing property that can benefit both
UNLESS trust agreement says otherwise (then might fix other ways like setting aside income from wasting asset for remaindermen)
how expenses are divided
1) ordinary expenses (inc taxes) charged to income
2) extraordinary expenses (inc taxes) charged to principal
(default rule)
