How can you tell the difference between a lease and a licence
look for the intention- whether or not the agreement grnatee exclusive possesion to the tenant (lease)

creates a relationship between landlord and tenant

if property is sold you cant cancel the lease

example is a long term hotel guest. no relationship

if propererty is sold you can cancel the licence

YES!! It has to be in writing and registered to be enforceable

it no longer becomes a residental and becomes commerical tenancies
