Offense specific. Each crime has its own set punishment that is set by statue. EXAMPLE DUI.

What is Miranda rights?
The right to remain silent, anything they say can be used against them, has the right to a presence of an attorney, and that if they cannot afford an attorney will be appointed for them.
When must Miranda rights be given?
During interrogation.
Is a “Frisk” allowed every time there is legal temporary detention of a suspect?
No, not automatically allowed just because a person is detained under reasonable suspicion.

What is the exclusionary rule?
Any evidence that is illegally seized by the police will be inadmissible in a criminal trial. Acts a deterrent to a police misconduct.
What is the “Fruit of the Poisonous Tree Doctrine?”
If evidence is seized is inadmissible in court because the police acted illegally, than other evidence obtained or found as a result of the illegally seized evidence will also be inadmissible too.
