Alternative arrangements
given vulnerable victims like cases of sexual offences or family violence. Using these arrangements can reduce trauma and distress
Not available in all cases only certain which is unfair
What arrangements can be made?
the witness can give evidence from behind a screen
legal practitioners may not be in robes to reduce formality
Giving evidence remotely
Closed courtroom
The right to be informed about proceedings
Victims of crimes should be knowledgeable about the case they are involved in, this is achieved through the victims charter
Within the charter the victims have to be told the following
details of the offence against the person
time and place of the hearing
the outcome of criminal proceeding
any appeal
Information does not need to be given in certain situations
The right to be informed of the likely release date of the offender
a person who is a victim of a violent crime may apply to the victims register and they will receive a likely release date. this information will be told 14 days prior to their release date
Committal proceedings
Committal proceedings are court hearings held in the Magistrates’ Court to decide whether there is sufficient evidence against an accused
Who may be a victim?
a person who has suffered directly or indirectly as a result of a crime
Not a party in a criminal case
Acknowledgement that victims of crime should be recognised, and treated with respect and be able to participate
