3 Discipline Types
Positive, Corrective, Progressive
Admin Leave w/ Pay is used for
For ongoing investigations; not appealable.
Progressive Discipline Steps
Verbal counsel > Verbal reprimand > Written reprimand > Suspension > Demotion > Dismissal
Suspension Approval
BC for up to 3 shifts; Asst. Chief or Fire Chief for >3 shifts.
Max Suspension w/o Pay
30 days
Appealable Disciplines
Dismissal, Demotion, Suspension
No Appeal Rights
Initial probationary employees, except for unlawful actions.
Disciplines to Document
Verbal/Written reprimands, Suspension, Demotion, Dismissal
Response Time for File
7 days for written reprimands, suspensions, demotions
Supervisor Must Provide
Letter of intended discipline
Fire Chief & Dismissal
Paid admin leave & pre-dismissal notice
Disciplinary Meeting Rep
Peer, Union, or Legal; notify supervisor.
Appeal Time Frame
3 days after final action; 3 days after management response.
ALJ Overturns
Sends matter back to Fire Chief for alternate discipline.
Appeal Step 1
Discuss w/ supervisor > Appeal w/in 3 days to next level > 7 days for manager reply
