A

(1) Rule 12(b)(2) ,(3), (4) and (5) must be put in your FIRST rule 12 response (these are procedural, helps efficiency if waived)

OR else waived

(2) 12b(6) and (7) Raise for first time any time through trial (merits are fundamentally challenged with these, sacrifice efficiency but worth it)

(3) 12(b)(1) is never waived
