Police power
The right to enact and enforce laws for the health, safety and welfare of the public.
Ex. Zoning laws, health codes, and building codes.
Eminent domain/condemnation
1.) The right to take ownership or private property for public use with just compensation pay.
2.) The legal process of taking property through eminent domain is known as condemnation.
3.) in Arizona before beginning a court action for condemnation, the property owner must be given a lease 20 days prior notice of pending litigation’s that include
A. A written offer to purchase for “ just compensation”
B. And appraisal supporting the amount of compensation.
Escheat
Reversion of property to the state due to the owner, dying without a will (intestate) and with no known heirs.
1.) after property is escheats to the state, the state will sell the property.
2.) Heirs have seven years after the sale to clean any sales proceeds.
3.) funds are placed in the states general fund.
