Can the mark be restored?

A

Restoration is possible within six months of removal by filing a form, renewal fee and
restoration fee. In practice, UKIPO also requires a Witness Statement or Statutory
Declaration detailing the reasons why the renewal was not timely filed. There should
have been a continuing underlying intention to maintain the registration. Restoration is at the UKIPO’s discretion. It is necessary to demonstrate that the failure to renew was unintentional.
