When are costs awarded on indemnity basis?
Wrongful conduct (awarded after Day 22<–> Judgement)

Default party cannot pay so go after someone with real interest in outcome e.g. sponsored party
What is costs awarded on standard basis?
Per cost budget report
What are fixed recoverbale costs costs awarded?
Complexity band
When can you depart from costs budget?
Good reason e.g. no incurred costs or much less than expected
Small claims costs awarded?
Cannot recover legal costs only disbursements
How are costs of interim applications asssed?
Summarily (immediatley at end of hearing)
Process of detailed assesment of multitrack costs
- recieve notice of detailed assessment order
- withn 3 months, serve notice of commencement (evidence of bills)
- paying party has 21 days to dispute
- recivieing party has 21 days to reply
- recieving party files for assessment hearing within 3 motnhs
costs less than £75k - judge decides what is allowed
right to appeal within 21 days but must get adjusted figure of at least 20% otherwise need ot pay other parties costs
Requirements for standard basis costs?
- reasonably incurred (disallowed if not)
- reasonable in amount (reduced if not)
- proportionate to:
- total sum
- additional work generated
- complecity
doubts resolved in favour of paying party

Effect of disallowing/reducing costs?
Cannot recover full amount from paying party
Why apply for security of costs order?
Defendant doesnt think C can pay costs owed + promise to set aside sums owed
Grounds for security of costs order*
- It is just to make it in the circumstances and
- one of more of part 25 conditions apply
Security of costs order - part 25 conditions?
- C lives outside EU/UK
- C has taken steps to make enforcement diffult
- C is impecunious company
What to show if claiming impecunious company?
Evidence of finances and assets
What does court consider when deciding if it is ‘just’ to grant security of cost order?
- D is likley to win at trial
- If the court believes the small business has a good chance of winning, it may refuse to grant the security order, because that would deny them the chance to bring the claim at all.
- C’s poor finances are becuase of D’s actions = no order
- apply for order asap
- C lives outside juridiction + unlikley to give security of assets
Process for security of costs order
- ask other party to volunatrily pay
- if no, go to court, notice + witness staement
- establish conditions + just + persuade them to exercise DISCRETION
Valid Part 36 Offer:
- in writing
- state it is part 36
- relevant period is ≥21 days
- whole/part of claim
- include counterclaim?
If claimant accepts within relevant period?
D pays standard/fixed from issue until acceptance
If claimant accepts outside relevant period (late)?
D pays from issue until Day 22 + C pay from Day 22 until acceptance
If D accepts late or within relevant period?
D pay C’s costs from issue until acceptance
When must paying party pay?
Within 14 days otherwise seek judgement
