What is legislation?
A law or set of laws that have been passed by parliament.
What is the Data Protection Act 1998?
The DPA states that organisations that store and process data are required to register with the Information Commissioner (the person responsible for the DPA) on the type of data being stored and why it is being collected.
What are the six principles of the DPA?
The DPA specifies that data must be:
- collected lawfully and processed fairly
- only used for the specified reasons
- stored only for the time necessary
- relevant and not excessive
- stored and processed securely
- accurate and up to date
What is the computer misuse act 1990?
It makes it an offence to:
- access data without permission
- access computer systems without permission
- alter data on a computer system without permission
What is the freedom of information act 2000?
States that people have a right to know about activities of public authorities, unless there is good reason for them not to. This means that public authorities are obliged to publish certain information about their activities, and that the public has a right to request information from public authorities.
What are some exemptions from the FIA?
- information held for criminal investigation
- information that could endanger health or safety
- information that could cause prejudice towards law enforcement
