How would you approach a negotiation?

A
  1. Prepare evidence to support claim
  2. Understand various approaches (may need to be a combination of tough but relaxed)
  3. Do not put yourself above or below anyone else
  4. Know what each side wishes to gain from the negotiations
  5. Prepare a best alternative (i.e. something you would settle on)
  6. Consider future business relationship

What is the significance of a letter that has ‘without prejudice’ written on it?

A

During negotiations, any concessions made whilst trying to settle by either party on a ‘without prejudice’ basis cannot be used against them in future legal proceedings
