Arms Act 1983 Section 40(2):
If any person refuses to give those details or gives false particulars, any member of police may:
a) caution the person and
b) if the person still refuses to give correct particulars may arrest without warrant.
Arms Act 1983 Section 40(1):
Power to demand particulars of anyone in possession of a firearm. Every person in possession of any: -firearm -air gun -pistol -restricted weapon Shall, on demand, give their: -full name -address -DOB *section 40 doesn't apply to imitation firearms.
Definition of Carrying:
Arms Act 1983
- Physically holding the object.
- Inside something they are carrying.
Define In possession:
Arms Act 1983
Possession means the same as carrying as well as:
- any person in occupation of any land or building
- the driver of any vehicle in which a firearm etc is found, is deemed to be in possession of that firearm unless they can prove:
1) it was someone else’s property
2) it was in someone else’s possession
Section 66:
Arms Act 1983
The occupier of buildings/land and the driver of a vehicle are deemed to be ‘in possession’ of any firearms etc found in their car/premises UNLESS they can prove that:
-The firearm was not their property and that it was in possession of some other person.
