Describe the tenure of the Legislative Council.

A

[Part VI, Article 31]

(1) Members of the Legislative Council hold office during His Majesty’s pleasure and in accordance with the terms contained within the Instrument of Appointment, which may also include the constituency or electoral area he is responsible for
(2) Members cease to become members when the Council is dissolved or when their seat is vacated.

(3) Seats may be vacated when a member is:
(a) Appointed as Regent
(b) Resigns his seat
(c) Absent from 2 consecutive Legislative Council meetings without the Speaker’s approval
(d) deemed to be disqualified under Article 30.

(4/5) Members may be declared incapable of discharging their duty as a member or declared suspended by His Majesty or the Legislative Council. That member cannot participate in any proceedings of the Council under he is declared to be capable of discharging his duties or declared unsuspended. Only His Majesty may overturn his own declarations.

(6) Members may be reappointed or re-elected if they continue to quality

(7) Questions of membership are determined by His Majesty, that is on:
(a) validity of disqualification
(b) validity of appointment, election or dismissal
(c) validity of the declaration of being incapable of discharging duty or suspension
(d) vacation of seat
