What is the purpose of the Victims’ Rights Act 2002?
Police are bound by the VRA to treat victims in a particular way and provide them with information about rights & services available to them.
Who classifies as a Victim?
Person whom offence is committed against/by another person, suffers physical injuries or loss/damage to property, guardian or parent of a child, immediate family members if the victim dies or is incapable
Who is defined as Immediate Family?
Parents/step parents, siblings/step siblings, spouse/de-facto partner, grandparents
Section 7 is what responsibility in the VRA 2002?
Courtesy, compassion and respect for their personal dignity and privacy
Section 8 is what responsibility in the VRA 2002?
Access to services that are responsive to their needs (health, counselling, legal, welfare, medical)
Section 11 is what responsibility in the VRA 2002?
Inform victims of services and remedies at the earliest opportunity (ACC, Women’s Refuge, Victim Support)
Section 12 is what responsibility in the VRA 2002?
Prosecuting authority to supply information about the progress of investigation, updates and outcomes of proceedings, charges filed/action taken
Section 51 is what responsibility in the VRA 2002?
Return of property as soon as practicable when no longer required as evidence
What is a Specified Offence under Section 29?
Offence of a sexual nature, serious assault, serious injury, death or incapable, victim with ongoing fears of physical safety, victim is a child
What is the VNR?
Victim Notification Register
What is the purpose of the VNR?
Victims can be informed of their rights and notified of offender/accused: bail, release, escape, death
Who manages VNR registrations?
PNHQ - Police National Headquarters
What form is given to victims who want to apply for the VNR?
POL1065
What needs to be updated if a victim chooses to apply for the VNR?
Victim Contact node in NIA
Who is responsible for keeping NZP informed of contact detail changes?
The victim
When do NZP need to consider a referral to Victim Support?
If the victim is involved in a serious incident, they are significantly affected by the incident or if they are likely to be involved in the justice system
What is a CVA?
Court Victim Advisor - helping victims through the court process
What form do NZP need to complete for a CVA to be used?
A CSV1 & a summary of facts - on or before the accused 1st court appearance.
All contact with victims need to be recorded and added onto what?
