Criminal Mischief in the Third Degree

1.the intent to damage property of another person
-damages motor vehicle of another person by
breaking in while the vehicle is locked w/ intent to
steal property
- within the pervious 10 yrs. have been
convicted 3 or more times, in separate criminal
transactions for which each sentence was imposed on
separate occasions of criminal mischief in the
4th,3rd,2nd or 1st degree.

Criminal Mischief in the Second Degree
- 10
- Intent to damage property of another person and having no right to do so, nor any reasonable ground to believe he has such right and exceeds $1500.
Class D Felony
Criminal Mischief in the First Degree
- 12
- Intent to damage property of another person and having no right to do so, nor any reasonable ground to believe he has such right, he damages property of another person by means of an explosive.
Class B Felony
Criminal Mischief in the 4th Degree

2. intentionally participates in the destruction of and abandoned building ( defined in section 1,971 real property actions and proceedings law)
3.Recklessly damages property exceeding $250
4. Intent to prevent a person from communicating for emergency assistance, disbales or removes phone, or other communication
or
- is attempting to seek or is actively seeking emergency assistance from another person or entity in order to protect him/herself or a third person from imminent physical injury. ( the fact that the defendent has ownership interest shall not be a a defense)
