It is an offence for any person to: Drive, attempt to drive or be in charge of a Motor vehicle on a road or other public place after consuming so much alcohol that the proportion of it in their breath, blood or unite exceeds the prescribed limit
What is the prescribed limit for breath
35 microgrammes of alcohol per 100 millilitres of breath
What is the prescribed limit for blood
80 milligrammes of alcohol per 100 millilitres of blood

107 milligrammes of alcohol per 100 millilitres of urine

It is an offence for any person to – drive, attempt to drive or be in charge of a mechanically propelled vehicle on a road or other public place whilst unfit through drink or drugs.

What 3 questions are required when requesting a specimen of breath
- When did you last consume alcohol? (20-minute gap required)
- When did you last use any mouthwash or breath freshener? (20-minute gap required)
- When did you last smoke? (5-minute gap required)
What 3 warnings are required when requesting a specimen of breath
- If you refuse to provide a specimen of breath you may be prosecuted
- If you fail to provide a specimen of breath you may be prosecuted
- If you provide a positive specimen of breath you will be arrested
What is Section 5 (A)
- Drives or attempts to drive a motor vehicle on a road or other public place, or
- Is in charge of a motor vehicle on a road or other public place, and there is in a person’s body a specified controlled drug over the prescribed limit.
