EXCEPTIONS FOR REMOVING ON THE BASIS OF DIVERSITY OF CITIZENSHIP- when jurisdiction is based solely on diversity

A
  1. no removal if the defendant is a citizen of the forum state OR
  2. no removal more than 1 year after the case was filed in state court
    - becomes removable if P voluntarily dismisses the Defendant that has the same citizenship as the forum state, but removal must be done WITHIN 30 days of the dismissal
