What are the two definitions for battery in KS?
(1) knowingly or recklessly causing bodily harm to another person OR
(2) knowingly causing physical contact with another person when done ina rude, insulting, or angry manner.
There are four definitions of Aggravated Battery. What is the first?
It occurs when the ∆:
Knowingly or recklessly causes great bodily harm to or disfigurement of another person
The second?
Knowingly or recklessly causes bodily harm to another person with a deadly weapon, or in any manner whereby great bodily harm, disfigurement, or death could be inflicted.
The third?
Knowingly causes physical contact with another person when done in a rude, insulting, or angry manner with a deadly weapon, or in any manner whereby great bodily harm, disfigurement, or death could be inflicted.
The final?
Operates or attempts to operate any vehicle while under the influence and causes the great bodily harm, disfigurement, or death of another person.
What does “great bodily harm” mean?
Means harm that is more than slight, trivial, minor, or moderate harm. Great bodily harm does not include mere bruising.
In KS, what is domestic battery defined as?
(1) knowingly or recklessly causing bodily harm by a family or household member against a family or household member; OR
(2) knowingly causing physical contact with a family or household member by a family or household member when done in a rude, insulting or angry manner.
What is a “family or household member”?
Persons 18 years or older who are spouses or former spouses, parents or stepparents, children or stepchildren, persons who are residing together or who have resided together, or person who have a child in common regardless of whether they have been married or resided together. Can also include a man and a woman if the woman is pregnant and the man is alleged to be the father.
What is abuse of a child?
Knowingly:
(1) torturing or cruelly beating any child under the age of 18
(2) shaking any child under the age of 18, resulting in great bodily harm to the child, or
(3) inflicting cruel and inhuman corporal punishment upon any child under the age of 18.
What are the separate offenses for batteries committed against persons while engaged in the performance of their duties?
(1) uniformed or otherwise properly identified law enforcement officers or correctional officers
(2) school employees while on school grounds or at school-sponsored events; and
(3) mental health employees by persons in custody.
Assault in KS definition?
Assault is knowingly placing another person in reasonable apprehension of immediate bodily harm.
What is aggravated assault?
An assault committed:
(1) with a deadly weapon;
(2) while disguised in any manner designed to conceal identity; or
(3) with intent to commit any felony
