Outline two articles in the Universal Declaration of Human Rights
Article 11 is that you have the right to be considered innocent until proven guilty. This is based on the presumption of innocence and allows all people charged with a crime to be able to fairly go through the criminal system without anything biases.
Article 19 is that you have the right to freedom of opinion and expression. This means that you should you able to speak your mind freely but must be balanced against the other rights.
Describe the key legal principle established by the Magna Carta in 1215
It is the Rule of Law. It is the concept that everyone is subject to the law, no matter your status (including the king) and it guarantees the rights of individuals, right to justice and the right to a fair trial
Explain the difference between refugees and asylums’ seekers
A refugee is someone who has been forced to flee their country due to fear/persecution and their refugee status has been granted by the UN. Whereas, an asylum seeker is someone who is seeking international protection but claim has not yet been decided upon
Outline one barrier faced by asylum seekers in securing human rights
As stated by Hannah Arendt, they don’t necessarily have the ‘right to have rights’ meaning because they aren’t citizens they don’t have access to many of the rights that a country offers making their lives very difficult and limiting the enjoyment of it.
Compare International Declarations and International Treaties
A similarity is that they are both international documents that outline a list of human rights.
A difference is that international treaties are legally binding whereas international declarations are not.
Identify the judicial organ of the United Nations and outline its role.
This is the International Court of Justice. It’s role is to settle legal disputes submitted to it by the states and give advisory opinions on legal question referred to it by authorized UN organs and specialized agencies.
Identify a limitation of this court
The court can only deal with a dispute when the states concerned have recognized its jurisdiction
Identify the express right written in section 116 of the Aus consitution
This is the freedom on religion. This means that a state cannot declare a national religion or prohibit a religion.
