Why is service of a claim a critical step?
Because it triggers the defendant’s obligation to respond.
Within how long of issue must a sealed claim form be served on the defendant where they are (1) within the UK and (2) outside the UK, and what is this period known as?
In the UK: Four calendar months
Outside the UK: Six months
It is known as the claim form validty period
E.g. a claim form issued on 20 January to be served on the defendant who is living in Bristol. The claimant must complete the step required by the CPR, in relation to the particular method of service chosen, before 12:00 midnight on 20 May.
If a claimant wishes to apply to have the claim form validity period extended, within what time period must the application be made, and only in what circumstances will the court grant it?
Application must be made within
* The original validity period
* The court will only grant it in exceptional circumstances
Where a claimant’s solicitors as opposed to the court will serve proceedings, what must the claimant ensure is enclosed, otherwise the court won’t deem service effective?
The response pack.
On whom must proceedings be served on when the defendant has nominated solicitors to accept service and where
1) Defendant is an individual
2) Defendant is a company?
Individual: must be served on solicitors, otherwise ineffective
Company : Solicitors or also may be delivered or posted to the company’s registered address
In the case of personal service to a company, who can accept service?
Any person holding a senior position.
In the case of personal service to a partnership being sued in the in the firm name who can accept service?
A partner, or any person who had control or management of the parntership business as its principle place of business at the time of service
On whom should the claim form be served on if the defendant is an individual, and solicitor’s have not accepted service?
On the individual.
Does the person being personally served have to take hold of or retain the papers?
No, as long as the process server has explained the general nature of the documents.
How can the claim form usually served?
- Either by the court / by the claimant / by the claimant’s solicitor - 1st class post
Where the claim form is served by the claimant, what must be filed at court and when?
Claimant’s solicitor must file a certificate of service at court
* within 21 days of service
* Unless all defendants have filed an ackowledgement of service within that time
What are permissible methods of serving the claim form?
Methods of serving the claim form
* Personally service (hand it at them / throw on feet)
* First-class post / DX
* Leaving claim form at a specified place e.g. lawyers office if they have confirmed acceptance of service
If expressly confirmed
* Fax, email electronic communication (a recpient indicated in writing that they are willing to accept service by fax / electronic)
* Solicitor letterhead - implies that they accept this mode of service
Any method authorised by the court
* In certain exceptional circumstances, the court can authorise service of the claim form by a different method, such as posting or delivering it to someone who knows the defendant or authorising service by text message, facebook
When is the deemed date of service for the particulars of claim form?
Deemed service - a document or application is legally treated by the CPR as having been served on the person, irrespective of whether it actually arrived
2 business days after the relevant step required (i.e. putting the claim in the post)
* Business days means any day except weekend, bank holiday, good friday or christmas day
E.g. if a claim form is sent by post on Monday, deemed served on Wednesday.
A firm of solicitors authorised to accept service by email and receives the claim form by an email sent on Saturday and Monday is a Bank holiday. When is it deemed served?
2 Business days.
- Therefore, Sunday, Monday (don’t count)
- Tuesday (1st business day)
- Wednesday (2nd business day)
Deemed service = Wednesday
What is the deemed service of other documents (not claim form)?
For service by personal service, delivering the document to a permitted address, fax, email.
Other documents - e.g. defence or part 36
- If served before 4:30pm on a business day - that business day
- If not, next business day
