What is implied consent?
Expression of expressing permission ie non verbally, with actions.
It is not valid consent.
What is expressed consent?
Verbal or written permission for treatment.
It is valid consent
Why do we need consent?
It is medico legal requirement
It is unethical to proceed treatment without it
It is illegal to treat without it, GDC,DDU
What is consent?
Patients permission to go ahead with treatment.
It is ongoing.
It is voluntary.
The patient must understand all txt options
It is not just a signature on a form
What are 3 principles of valid consent?
(V.I.C)
Voluntary
Informed
Capable
What age can a child give consent?
16 years+
If they are capable of giving valid consent
( Voluntary,Informed,Capable)
What is Gillick competency?
If they are under 16 but have the understanding and capability to give valid consent. (V.I.C)
When can parents give consent?
Mum as shown on birth certificate
Dad if he has legal rights.
Legal guardians as recognised by a court of law.
When could parents give consent before 2003?
Mum and dad ( as named on birth certificate at time of conception)
How would you secure consent?
Take medical history Check patient details Explain risks, benefits Offer a cooling off period Ensure patient is in the position to give( V.I.C) Written,verbal,record.
What is “Transition”
When a patient goes from being classed legally as a child to a young adult.
