What is alimony
Spousal support is paid to an ecomonically dependant spouse.
There are fourt types and courts may grant more than one type.
What are the four types of alimony?
- Permanent periodical spousal support
- Lump sum
- Rehabilitative Spousal Support
- Reimbursement Spousal Support
define
- Permanent periodical spousal support
PPSS
Is paid regularly to support a spouse who has neither the ressources nor the ability to self-sustain.
Can be modified upon proof of substantial change in circumstances (death, remarriage).
Lump sum
Fixed amount payable all at once or via a series of payments.
Not modifiable.
when exam states total amout = lump sum / if exam states no grand total
Rehabilitative Spousal Support
RSS
Periodic payments for a limited tme to enable a spouse to gain skills to become self-supporting.
For specified time.
Can be modified upon proof of substantial change in circumstances.
Reimbursement Spousal Support
RSS2
Occasionally awarded to as pouse who supported the other spouse during education.
Not modifiable.
Micelanous
- Fact that spouse wanted to remarry upon divorce ≠ change in circumstances that would change alimony
- self-induced reduction in income is notsufficient to have spousal support reduced
