What can Police demand from people in possession of firearms (s40 Arms Act 1983)?
every person shall on demand give full name, address and DOB.
If refuse, Police may caution that person and, if they continue to refuse or give false details, arrest without warrant
Who is deemed to be in possession of a firearm for a premises or vehicle?
Premises - every person in occupant shall be deemed to have possession
Vehicle - driver deemed to be in possession
…unless proves that not his property and it was in the possession of some other person.
Who can deploy with firearms?
certified level one responders
When can firearms be carried?
- when PCA of situation in death/GBH range
- on duty as AOS/STG, or Protection Services as authorised by supervisor
- airport duties at a ‘security designated’ airport
- role of escorts and guards for people carrying valuables as authorised by District Commander
- destroy animals
- training purposes
An offender must not be shot without first considering what?
communication - they have been asked to surrender (unless impracticable/unsafe to do so).
Less violent alternatives (proportionality) - they cannot be disarmed or arrested without being shot.
Delay (necessity) - further delay would be dangerous or impractical
When can Police use firearms?
- defending themselves or others if fear death/GBH (s48)
- arresting offender if RGTB they pose threat of death/GBH and cannot arrest in less violent manner and can’t be delayed (s39)
- prevent escape (s40)
- destroying animals
When can warning shots be fired?
As a general rule, warning shots should not be fired. Circumstances where appropriate:
- suspect asked to surrender and has not done so
- clearly aimed as a warning shot
What must an incident controller do for a discharge involved death or injury?
- take control of scene
- ensure first aid rendered
- manage scene
- inform District Commander
What must be done by incident controller to take control of scene?
- mark discharging employees position, empty cartridge cases, bullet fragments, etc
- preserve cartridge cases
- secure firearm and remaining rounds
- preserve and photograph scene
- advise employees supervisor
When must a TOR be submitted for use of a firearm?
- presentation of a firearm
- discharge of a firearm
- unintentional discharge
- destruction of animals
What must a supervisor do after operational use of a Taser?
- consult with operator around requirement for physical attendance at scene
- ensure aftercare and medical attention provided
- ensure scene preserved and photographed, recover all evidence e.g. cartridges, and secure
- ensure subject exposed examined by registered medical doctor (recorded in POL42)
- operator completes details in taser register
- operator submits TOR
- operator uploads incident into evidence.com
